David Goldman has won custody of his son, Sean, after the Brazilian Supreme Court ruled on Tuesday. Read more on the Brazil custody battle below.
David Goldman was informed by Brazil’s lower court that he could come get his 9 year-old son Sean and bring him back to New Jersey. But after traveling to Brazil last Thursday he was told a Federal Court had overruled the lower court’s decision.
Sean Goldman was taken by his mother to Brazil, and Bruna Bianchi died last year during childbirth. Her family has filed a stay in Rio stating that it won’t be healthy for Sean to be uprooted from his life in Rio, Brazil.
A decision was expected on Monday evening but was delayed until Tuesday. The Brazilian family who has David Goldman’s son attempted to make a last minute deal with Goldman Tuesday, and stated that he could have him if the boy’s maternal grandmother could return with them to New Jersey.
The Brazilian Supreme Court has ruled that David Goldman will get custody of Sean and that the family now has 48 hours to turn Sean Goldman.. The Associated Press reported that lawyers for both sides have said there is still a slight chance of an appeal before David Goldman can get Sean on an airplane bound for the US.
Let’s hope David Goldman will finally be able to bring his son home.
